For Property Owners Using the Bizae Owner Dashboard

1. Overview of Services
Bizae ("Company," "we," "our," "us") provides a digital platform enabling property owners to view reservation data, financial reports, expense logs, payouts, and other operational information relating to short-term rental management. The Platform is provided as-is, for convenience, and is not a substitute for formal accounting or legal documentation unless expressly stated.
2. User Eligibility
To use the Platform, you must:
- Be the legal owner or authorized representative of the property/properties managed through Bizae
- Have an active management agreement with Bizae
- Provide accurate and current contact, banking, and identity information
We reserve the right to deny or revoke access to the Platform at any time.
3. Dashboard Data Is Preliminary and Subject to Change
All information displayed in the Owner Dashboard—including but not limited to reservations, payouts, fees, expenses, maintenance charges, commissions, refunds, and statements—is considered preliminary, subject to verification, and non-binding.
Data may be modified by Bizae after the fact in order to correct errors, apply refunds, process cancellations, integrate chargebacks, reconcile accounts, or update incomplete entries.
Owners acknowledge that dashboard information may not reflect real-time financials.
4. Right to Modify, Correct, or Adjust Information
Bizae retains the full right and discretion to modify, correct, adjust, or update any dashboard data at any time, including after statements or payouts have been issued.
This includes adjustments related to:
- Accounting or bookkeeping errors
- Guest cancellations or modifications
- Refunds or partial refunds
- Chargebacks or payment disputes
- Misstated revenue
- Fraudulent bookings
- Reporting errors
- Duplicated entries
- System or integration malfunctions
- Missing fees or corrections
Owners agree that such modifications may impact future payouts or outstanding balances.
5. Refunds, Chargebacks, and Guest Disputes
Owners understand and agree that:
- Refunds issued to guests may reduce owner payouts
- Chargebacks may result in negative balances
- Disputes may take 30–180 days depending on the payment processor
- Bizae may adjust financial entries even after a stay has been completed
- The company is not responsible for financial losses caused by guest behavior, non-payment, or third-party processors
If an owner's account becomes negative, the owner authorizes Bizae to deduct the balance from future rentals or send an invoice for immediate payment.
6. No Liability for Dashboard Errors or Delays
Dashboard data may be delayed or temporarily inaccurate due to:
- Payment processor delays
- Bank holds
- Manual reconciliation
- Software errors
- Missing data from booking channels
- Maintenance or operational updates
- System outages
Bizae is not responsible for any decisions or expectations based on preliminary dashboard data.
7. Owner Responsibility to Review Statements
Owners agree to review statements and dashboard entries and notify Bizae of any discrepancies within 7 days. Failure to notify is considered acceptance of the information.
8. Commission, Fees, and Deductions
By using the Platform and engaging Bizae's services, the Owner acknowledges:
- Commission rates and service fees are defined in the management agreement
- Additional deductions may apply for maintenance, materials, supplies, HOA fines, cleaning, repairs, or special requests
- Bizae may deduct fees before issuing payouts
- Owners authorize Bizae to manage and collect funds on their behalf, including holding deposits and handling guest payments
9. Payment Timing and Payouts
Payouts are processed according to operational timelines, subject to delays related to:
- Banks and processors
- Guest payment failures
- Cancellations
- Chargebacks
- Platform reconciliation
Bizae is not responsible for payout delays caused by third parties.
10. Use of the Platform
Owners agree not to:
- Interfere with Platform functionality
- Attempt unauthorized access
- Copy, resell, or distribute Platform content
- Upload malicious code
- Manipulate or misrepresent data
Misuse may result in termination of access.
11. Confidentiality & Data Protection
Owners must protect their login credentials and dashboard data.
Bizae uses reasonable security measures but does not guarantee that the Platform is free from vulnerabilities.
12. Limitation of Liability
To the fullest extent permitted by law:
- Bizae is not liable for lost profits, missed bookings, indirect damages, or reliance on dashboard data
- All Platform content is provided "as-is" and "as available"
- Bizae's total liability shall not exceed the total management fees collected from the owner in the past 90 days
- Owners waive claims related to system errors, miscalculations, delays, or data inaccuracies
13. Indemnification
Owner agrees to indemnify and hold harmless Bizae, its affiliates, and its personnel from any claims, losses, damages, legal actions, or liabilities arising from:
- Use or misuse of the Platform
- Owner negligence
- Violations of law
- Inaccurate owner-provided information
- Disputes with guests
14. Termination of Access
Bizae may modify, restrict, or terminate dashboard access at any time, including upon:
- Termination of management agreement
- Violation of these Terms
- Suspected fraud
- Server or system maintenance
Owners remain responsible for outstanding balances even after termination.
15. Amendments
Bizae may update these Terms at any time. Updates take effect upon posting. Continued use of the Platform constitutes acceptance of updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
17. Acceptance
By accessing or using the Owner Dashboard, you confirm that you have read, understood, and agreed to these Terms of Service.
